Schellenberg Wittmer wins request for revision for USA Gymnastics: Swiss Supreme Court annuls CAS award that deprived Jordan Chiles of her Olympic bronze medal

The Swiss Supreme Court has upheld the request for revision submitted by Schellenberg Wittmer for USA Gymnastics and annulled the award rendered by the Court of Arbitration for Sports ("CAS") that had deprived US gymnast Jordan Chiles of her Olympic bronze medal.

The case arose from the women’s artistic gymnastics floor final at the 2024 Olympic Games where Jordan Chiles was initially awarded the bronze medal after her coach's oral inquiry led to an increase of her score. A CAS panel later ruled that the oral inquiry had been submitted four seconds after the expiration of the applicable one-minute deadline and was therefore without effect. As a result, Jordan Chiles lost her medal.

However, shortly after the dispositive section of the award was issued, audio-visual evidence emerged showing that the oral inquiry had been raised within the time limit. Schellenberg Wittmer filed a request for revision of the award on behalf of USA Gymnastics, the US national gymnastics federation, based on the newly discovered evidence.

In its decision dated 23 January 2026 and recently published, the Swiss Supreme Court accepted that the newly discovered audio-visual evidence may demonstrate that the oral inquiry had been made within the strict regulatory time limit — a central issue on which the CAS award was based – and could therefore have materially affected the outcome of the award. As a result, it annulled the award and referred the case back to CAS for reconsideration taking into consideration the newly available evidence.

The Supreme Court very rarely grants a request for revision. The Court stressed the highly exceptional circumstances of the case. By contrast, the Supreme Court dismissed the parallel challenges brought by other parties.
